Tax Office News:

Keep your eys on this space for the key tax issues that we will be profiling for our clients.

In Essenbourne Pty Ltd v Commissioner of Taxation [2002] ATC 5201; (2002) 51 ATR 629 the Federal Court held that the taxpayer was not entitled to a deduction under the income tax law for its contribution to an employee incentive trust. This was because the Court concluded that the payment of the contribution did not have the necessary connection to the taxpayer’s business. The Court held that the payment was simply a means by which the three principals could share in the profits of the business and at the same time obtain tax advantages. The Court also decided that the contribution was not a fringe benefit for the purposes of the fringe benefits tax (FBT) law.
The decision of the Court meant that the scheme was not tax effective.
